The US Department of Transportation (DOT) requires all employees in safety-sensitive positions to be drug and alcohol tested after being involved in an accident, so long as the nature of the accident meets certain criteria outlined in the Code of Federal Regulations (http://www.dot.gov/ost/dapc/). Companies that do not fall under the DOT guidelines may also need post-accident testing for their employees who are involved in an accident if such testing is specified in the company’s drug and alcohol policy.
DOT requires the drug test be performed within 32 hours of the accident and the alcohol test be performed within 8 hours. These timelines are also recommended for companies who do not fall under the DOT guidelines.
